N. Ram on Navin Chawla episode – An Offstumped dissection

It seems that leftist rag tag The Hindu has taken on the cudgels on behalf of the Congress and Navin Chawla to attack N. Gopalaswami. The Hindu’s editor N. Ram himself is personally leading the crusade. Today Mr. Ram’s paper has fired from all cylinders on the CEC.

Offstumped dissects all three op-ed pieces by N. Ram to expose facts from hyperbole.

First headline from the Hindu reads “Gopalswami’s claims on timing of missive are misleading“, which leads us to these 4 questions.

Qn#1 – So what exactly does N. Ram have to say on this timing ?

Qn#2 – how do they square with anything the CEC has said ?

Qn#3 – by what yardstick of logic are they misleading ?

Qn#4 – and where exactly are they misleading to ?

Qn#1 – What is N. Ram saying on the timing ?

Mr. Gopalaswami has gone on record essentially blaming Election Commissioner Navin Chawla for the timing, claiming that he sent his ‘final reply’ to the allegations made in the BJP’s petition only on December 10.

A careful, item-by-item verification by The?Hindu of the CEC’s claims on what happened within the Election Commission between January 30, 2008 and January 12, 2009 reveals that they are seriously misleading.

So by “seriously misleading” one must conclude, N. Ram’s contention is that Navin Chawla’s “final reply” did not come on December 10th but much earlier, so what does N. Ram have to say further on this.

Qn#2 – how do they square with anything the CEC has said ?

After 4 paragraphs of legal gobbbledygook comes this contention which is the basis for N. Ram’s claim

Mr. Chawla’s ‘final reply’ of December 10 was only a reiteration of the important constitutional points he made in his reply of September 12 plus a rejection of the BJP’s allegations as “motivated and entirely baseless.”

So basically what we have here is that Navin Chawla sent a reply on Sept 12th to the CEC, the CEC was not satisfied with that reply and hence asked for a reply on the merits of the petition from Navin Chawla which never come until the December 10th reiteration of the earlier reply.

How pray does this make Gopalaswami’s claims misleading ?

Its a classic media trick to pass off a canard in the headliners when the facts to back up the canard are either or non existent.

So if one were to take N. Ram’s headline at face value one would mistakently conclude that the CEC was deliberately misleading when in reality the CEC did no such thing.

Qns#3 & #4 - by what yardstick of logic are they misleading and whereare they leading us to ?

The CEC’s claims would be misleading if either he was lying which N. Ram is not accusing him of, or if the CEC were to have different motive for having waited till December, which too N. Ram is not accusing him of.

The CEC’s claims merely tell us that Navin Chawla did not provide any answers to the questions in the petition. He merely spent all the time challenging the CEC’s right to ask those questions.

How pray is this misleading ?

In fact if anything it only further puts the spotlight on Navin Chawla for dodging the questions posed to him.

So practically there is no logic to N. Ram’s accusation here.

The second detailed story The Hindu is running is the so called factual record.

The record stands out not for its detailing of cold facts but the choice of language that makes Navin Chawla come out looking like the law abiding, obedient  sub-ordinate and Gopalaswami looking like the overbearing boss about to get him.

Here is a sampling

Treating all this as irrelevant, the CEC sent two more reminders ……

Language is not the only problem with this so called “factual record” by N. Ram. It is the freedom with which Mr. N. Ram mixes his personal opinion that exposes his prejudices and personal biases .

The wonder is that as this unseemly drama was progressing and the internal blood-letting getting worse, the three-member Election Commission managed to conduct Assembly elections in six States

Mr. Gopalaswami, who will retire on April 20, fired what he thought was his Brahmastra. It seems to have backfired.

The bottomline folks is that, after all this verbal skullduggery and chronological gymnastics, neither Mr. N. Ram, nor the Congress Party or Navin Chawla have actually spent even a moment explaining Mr. Chawla’s conduct or defending his record. This entire exercise is aimed solely at questioning Mr. Gopalaswami’s intentions and damaging his credibility to ask him how dare he have the temerity to recommend the removal of Navin Chawla. That is why the Congress Party, Navin Chawla and their minions in the media like N. Ram stand exposed.

    Neither N Ram nor others explain what is wrong with the timings!
    Had he recommended this in 2008, these “eminent” personalities would have accused him of helping BJP ahead of Karnataka elections (May 2008), Chatisgarh/MP elections (Nov 2008) or Delhi elections (Dec 2008).
    I wonder, according to these guys what probably is the “right” time for CEC to make such a suggestion.

    N Ram is once again exposing how irrational he is.

The law minister already stated (vernacular news paper reports) that next CEC will be chawla!!! and he is concerned about N.Gopalaswami treated BJP cadets fairly with tea when they visited his office.Ane he says CEC should not be a Political leader and all the ECs have same power according to the seniorty one can become CEC!!!! all POLITIRCKS!

It is a pity Manmohan singh did not die on the operating table — that would have removed this aura of “integrity and honesty” that these criminals in the congress party pretend to possess just because of his existence.

    I am not so good at conspiracy theories you know. For eg.I would have never figured out that MMS’ 8 hr operation was actually a “script” to pave way for Rahul, as I was informed here. My simple thought would have told me why at all a script is needed? So there you go..:)

    N.Gopalaswami was from the Gujarat cadre of IAS officers of 1966 batch. He served in Gujrat for 25 years . Prior to his appointment in the election Commission, he was Secretary, Home Ministry, under Advani. He was appointed as Election Commissioner on 8th February, 2004 under BJP led NDA Govt.On 22nd May, 2004, UPA govt. was sworn in.On 16/5/2005. N.Chawla was appointed as Election Commissioner II.On 29/6/2006, N.Gopalaswami was appointed as Chief Election Commissioner.Consequently Chawla became EC I ,senior most to succeed CEC on his retirement due on 20/4/2009.
    Fourteen months after the appointment of N. Chawla, and eight months after the appointment of the CEC,on 14/2/2006 NDA delegation met President Kalam Again after one month, on 16/3/2006 A memorandum signed by 205 MPs was submitted to the President detailing allegations against N. Chawla!President forwarded the same to the Govt.of India rather than the CEC!Govt.in turn, referred it to the attorney general for his opinion.The latter reported that the allegations related to a period when Chawla was not an Election Commissioner and hence, the question of his removal from that office did not arise!Hence,the Govt. blocked its reference to the CEC.On 11/5/2006,Jaswant Singh, Leader of the Opposition in the Rajya Sabha, moved the Supreme Court challenging the Centre’s action.On 22/6/2006, the Supreme Court issued notices to Central Govt. and the CEC.After 15 months, on 6/8/2007,the CEC shocked the centre telling the Supreme Court that he had powers to ’suo mottu’ initiate action against an Election Commissioner and recommend his removal! Bouyed by the CEC’s stand Jaswant Singh withdrew the case the very next day and promised to take up the matter with the CEC.However. the BJP’s petition to CEC was personally handed over on30/1/2008 only!(Five months after withdrawal of the case).
    The CEC took action on it on after six months(on 21/7/2008)only!And Chawla replied on 1/9/2008, raising objections against the CEC’s stand and his preference to refer to the Law Ministry.In November, 2008, the Law Ministry,took the view that CEC could not proceed with the inquiry,as any recommendation for removal of an EC could be only on reference to the CEC from the Govt. The same point was mentioned in Seshan’s case in 1995.On 8/11/2008. CEC sent “show cause notice to Chawla.He replied on Dec 10,2008. And the CEC sent his report to the President on12/1/2009. As per the Constitution, the President could act only on the advice of the Central Govt. the president has sent CEC’a report to the Govt.From the above two things become quite apparent. (1) the Fifteeenth CEC has out done the cotroversial Tenth CEC-T.N.Seshan!(2)CEC has taken a stand on the second Proviso to Art.324(5),wherein the word “should” has been used. It indicates
    actions that are discretionary and in case of need.Hence, it is not givng any “mandate” to the CEC.On the other hand the averment of the Law Minister
    appears quite valid. Sec, 3 of the said article uses the word “shall”, which means the action is “mandatory”.On the appointment of other Election Commissionsers on the same conditions of service and pay,the all powerful CEC is to act as “Chairman” of the Election Commission., “first among equals” and not “boss” of other members. Thus, Gopalaswami’s act has been “unconstitutional and unfair” as The Hindu has summed up.

More than 200 Memebers of Parliament belonging to NDA signed a memorandum, requesting for the removal of Navin Chawla, submitted to the then President Dr Abdul Kalam. The BJP, through Jaswant Singh, opposition leader in Rajya Sabha, followed it up with a petition in the Supreme Court in May 2006 praying for his removal. As the Chief Election Commissioner Gopalswami rightly filed an affidavit saying that he had the powers to remove any member of the EC for substantial reasons, the BJP withdrew the petition and forwarded it to the CEC. Now you say CEC “shocked” the centre. Pray what the “shocked” government did or failed to do after getting the “shock” treatment.

    Now CEC has already made clear why the delay and it is everywhere in the media. Perhaps the Congress and their supporters are still in a “shocked” state of mind, are not able to come out of their “shock”.     We thought our judiciary, our Election Commission are independent entities, are not under the Law Minister which the present Law Minister claims “I am the boss, not CEC: Bhardwaj”. The present government has undermined independence of every institution, the judiciary, the election commission and all other such institutions. They are appointing their minions to man these positions to serve their purpose.

    We the ordinary laymen are not experts in law. But we know that Shri Chawla is biased in favour of Congress. These positions should not be disgraced. Persons acceptable to all should be elevated to these positions. The very existence of our democracy depends upon independent judiciary, independent Election Commission, etc. It is not a question of Congress, BJP, Chawlas, Gopalaswamis, N. Rams, etc. It is a question of India and democracy. Every dissenting voice should be heard and due attention given.

    I don’t want to deep into Shri Gopalaswamy’s record. The AAM AADMI in me sees only simple things:

    1. During the last elections in WB, Mr. Gopalaswamy’s watch was so thorough that the Comrades went whigning all over that, they are being victimised. They won a thumping majority, but this shows that if you a CEC of Shri Gopalaswamy’s calibre, even the Hammer and Sickle clad commies wet their pants.

    2. For me, the complicity of Naveen Chawla with the CON gress during the emergency day’s itself is enough of him being sacked from any public office.

    Why beat around the bush, we must go for the kil and demand that we do not trust this white trash ass licker, thats that.

    I completely agree on the above point. Over the time i have realized one thing, If media (print or electronic) is taking any stand, then it must be verified before we start believing it. Media should report the news not it’s stand on any particular issue…

    nice observatiosna dn article. i think we the citizens of india should fight for the constitutional rights and launch to boycott elections if NAVIN CHAMCHA sorry Chwala is appointed as CEC. I am 100% confident that the president will not look into the matter which will be refferred backto the govt and everyone know what is govt’s stand on this.
    There could be more dots which needs to be connected which will be useful for a reader flike me.

    You say we should go for the kill. What do you mean by that? Do you want BJP to boycott elections if its held under Chawla? Well that wont happen mainly because it would setting a precedent. Tomorrow any party will stand and say we are boycotting since we dont trust the CEC.

    I agree with all the points as regards to Chawla being biased but I dont think boycott is the solution for it. Also, see we might abuse congress till cows come home but from their perspective it would be harakiri to drop Chawla now since it would be tantamount to admitting he was their man.

    What every media is forgetting is the remarks made by SC when the petition was being herad and before CEC submitted that affidavit.

    Alleging that the Government was blocking the constitutional process, the BJP had then approached the Supreme Court, which remarked that the Attorney General had no locus standi in the matter and the BJP could move its petition directly to the CEC, who will communicate his view to the President.

    It is at a following hearing that CEC filed an affidavit of his powers.

    So it means if BJP were to approach court CEC action of recommendation to president based on BJP petition and his own experiences, I hope will not become a issue.

    The Congress (read the family) has always undermined (remember willy nilly constitutional amendments during emergency) the constitution and considered itself above the law. Although, I do not have a full list since independence but I have been tracking their deeds since 2004. Here are some of the examples:

    1) Sacking of the 4 governors appointed by the NDA government for no reason
    2) Union Law minister, H R Bharadwaj, making a statement that Sonia Gandhi could ask for any govt. files (With what constitutional authority?)
    3) Using ordinances instead of bringing legislation
    4) Projecting Sonia Gandhi as extra constitutional authority on multiple occasion even at the expense of undermining office of the prime minister
    5) Dissolution of the Bihar assembly (for which they were rightly got slap on hand by the SC, I wish if it were something more severe)
    6) Using governors in various states (for e.g. SC Jamir, SS Razi, or the gov. of Gujarat) for their own political purposes (Mansabdari at its worst)
    7) Mixing executive posts and conflict of interest (for e.g. Sushil Kumar Shinde was brought back as CM when he was serving as Gov. of AP) 8) The way whole office of profit affair was handled

    It does not really matter who comes next, but this government has got to go!

We want a Nationalistic Government as soon as possible. to re-establish Dharma in India! people who was in Italy along with their kids and supporters should be send back to Italy, after they losses power, even a constitution amendment is required for that change it as soon as possible.
    What authority she has to look at Bharath Government files???? A president of ruling party or ruling ally did not allow that. Ultimately PEOPLE HAVE TO ANSWER THROUGH VOTES!

    Day before yesterday there was an article in the Rediff.com. Everytime a crucial discussion was under way, Chawla used to excuse himself and go the washroom and surely enough within minutes some Congress bigwig, Govt. officials or Ministers would call and ask Gopalaswamy about his proposals and whether he could change them in a certain manner. How these Congress bigwigs got wind of what was being discussed, particularly about the dates of election, followed by brazen attempts to influence his decision, is anybody’s guess – a two plus two mystery. They have reduced every single institution to an extension of Congress office, where only one person’s whims rule. And they’re sore about the instittuions which refuse to toe the line and genuflect. Gopalaswami has to be felicitted for his guts in standing up to this emasculation of one of the last bastions of integrity.

    I’ve stopped watching NDTV too and I hope I won’t repent for sure!

    Apart from doing these things, I think I am powerless as an aam aadmi.

    Having said that, will the other parties or right minded people take the judicial route in this episode or will congress as usual succeed in subverting democracy??

    N.Ram probably thinks that a GONE-gress govt would help him with all impt.govt ads.He knows if AIADMK & BJP are voted his paper would go RED which he cannot afford though his ideology can.A classic example of how important govt ad support is- will be found in The Hindu’s admonishment of K’taka govt on Mangalore incident ( I feel its getting more than required coverage) and the scathing attack on Modi and other BJP govt where The Hindu has no circulation.I sincerely hope the media is made to lick its wound. They will not talk about this if it had happened in W.Bengal/Kerala. One important thing – the reason why the print & electronic media is against Modi is that he spends very litlle money on govt ads instead spends it for development.
    Point to be noted – No story on Pinnari Vijayan’s CBI case in The HIndu.

    This is about Venkat’s mail. I’ve always found The Hindu to be too staid to hold my attention. But I started telling others to give up The Hindu (not with much success, I am afraid) the day it published an article by Om Veldt in which brahmins chanting Vedas were categorised as ‘a bunch of dogs barking with their tails interwined’. (I am recollecting from memory, this is not a verbatim reproduction, but in substance the observation is correct). This was too distasteful, repulsive for me and I would have felt the same way if the religion involved were different. Ram’s is not just scurrilous journalism, it’s more than that – he’s driven by a fiendish antipathy towards Hindus and right wingers. With the Religion he swears by – Marxism – now being a museum piece, jettisoned by history, orphaned and alone, unable to come to terms with the God that failed, he is still holding on to the carcass of ideology long after the spirit has left, and this has made him more venefic, and always on the look out for causes that could give him a sense of relevance. What better way than to oppose anything that BJP supports.
