National Interest not Human Rights first

Justice Rajinder Sachar has penned an op-ed in the Times of India titled “Human Rights first“. The below is a rejoinder from Offstumped to this op-ed.

The retired Justice of the famed report on social conditions of Muslims, makes broadly 4 points.

#1 – The BJP is trying to score a political point

#2 – TADA was bad to begin with, hence provisions similar to it in POTA are bad as well

#3 – NHRC opposed POTA

#4 – New York Times opposed the Patriot Act

#5 – SC observed that Human Rights are important

#6 – Any new legislation must be opposed

The first point needs no rejoinder, it is very clear that there is only one political formation in the nation today that has taken the War on Terror seriously and it is the BJP.

As far as his second point on TADA ?goes he goes to great lengths to quote statistics on TADA but the main point he makes is that TADA allowed for confesions to police be admissible, POTA wants the same. TADA was bad so POTA is also bad. He goes?to quote the Supreme Court on Police brutality

but offers no concrete data to make his case that the provisions within TADA on the specific aspect of confessions made to police were misused to a degree or ineffective to explain the ineffectiveness or vicissitudes of TADA.

His third point on the NHRC needs no rejoinder, Offstumped has documented on multiple occassions how ideologically biased the NHRC has been and how selective it has been in its activism. its opinion on POTA frankly is about as objective as those of the motley group of jhola bearing drifters, losers and vagabonds that abound countercurrents.org.

His fourth point on the New York Times and patriot act is laughable. The United States has not had a single terrorist attack on its soil since 9-11 while India has lost count of the number of attacks since POTA was repealed. Not to speak of the hypocrisy of this breed of psuedo intellectuals who scoff at American Imperialism but have no qualms of seeking ideological guidance from the New York Times.

His fifth point on the Supreme Court is duplicitous. He initially claims that Supreme Court upheld the supremacy of Human Rights over everything else. He then goes on to quote the Supreme Court in which the court says no such thing. It merely emphasises that Human Rights are important and that Government must not do anything to violate the Consitution.

His last point makes it clear that he has nothing constructive to offer by way of suggestions for how the War on Terror must be executed. He once again reminds us that his breed of psuedo intellectuals thrive on negativisim and have no positive agenda to offer. If he really cared for national interest he would have done better than stake out a political position on this issue to lay out atleast 2 alternatives which to him are superior legal means to deal with Terrorism.

Offstumped’s Challenge to Justice Rajinder Sachar

Sir if you claim such moral indignation on the draconian provisions of POTA and also claim such legal acumen on the effectiveness of existing laws to deal with Terrorism, pray why havent you pointed a single instance in which existing legal provisions have been effectively used to root out terror.

If Sir you cannot provide such instances, why is it that you have not offered any positive criticisms on where the existing legal provisions are failing in dealing with Terrorism and how pray they maybe fixed within the existing legal framework.

If you and your breed of intellectuals, activists whatever you call yourselves have nothing positive or constructive to offer to the victims of Terrorism or to the citizens of this nation who care about National Interest, could you please take your activism elsewhere and spare us this sanctimony.

India has always been guided by Dharma and will continue to do so as it defends its strategic interests in this asymmetric war waged on it by non-state actors.?

    Human rights first – is perfectly fine, but then are they not supposed to be SAME for all humans? will the pseudo secs follow this first….

    Also upholding human rights is till there are human beings…. but why talk of human rights for those who take human life?

    human rights, law etc comes into being when a set of human beings align to a nation. Once national law is formed it includes human rights… so national law … nation is supreme. When you become a citizen of a nation the constitution gives you certain rights… but … the rights also have associated duty…pseudo secs only talk of rights why not the duty as well….

    I guess if NHRC speaks for the rights of these so-called ‘humans’, which as is obvious to even a layman now that those ‘humans’ are in fact terrorists & traitors, isn’t it high-time an orgainsation that speaks for the victims of terror be set up? Rajinder Sachar, with all due respect, is nothing but a crony and joined @ hip pal of the likes of Khushwant Singh & his Candle-holding-At-Wagah border buddy Kuldeep Nayyar.

    All these ‘human right activists’ have a hissy fit whenever either terrorist & fundamentalist Muslims or Christians are deemed responsible for nefarious acts committed by them, I have never seen NHRC speaking up for Hindus fighting for their rights & against persecution in Kashmir, NE, tribal belt or even as has been the case in recent terrorist attacks – accept it that majority of whom perished in there were Hindus!

    Rajinder Sachar should go and settle in Pakistan or Saudi Arabia, then only he’ll come to realize the ‘real’ human rights…I dunno why & how these morons even get so much space in media to spill out their plan & support for breaking up or balkanizing India!

    The influence of RSS associated organisations and their growing service activities has led Christian missionaries and Congress leaders to panick so much that they have started misleading people by floating fake organisations. The Congress-Christian combine formed a fake Sewa Bharati in Delhi and announced the holding of a public function under its banner on September 18. But it was caught before it could cause any damage to the reputation of the original Sewa Bharati. It is a fact that Sewa Bharati, Delhi has earned a good respect among people living in slum and J.J. clusters with its service activities as well as with the programmes to uplift weaker section of the society. Such welfare activities have made people aware enough to stop entry of Christian missionaries in their localities. The missionary activists, with the help of some Congress leaders, formed an organisation, Sewa Bharati Sanstha, Delhi. Over 95 per cent its office bearers are Christians and the remaining are local Congress leaders. They published an advertisement in several newspapers regarding a function at Punjabi Bagh stadium on September 18. Delhi Chief Minister, Sheila Dikshit, Congress leaders Oskar Fernandes, Dr Karna Singh, Sajjan Kumar, Sandip Dikshit and film actor turned politician Govinda were scheduled to participate in the function.

    The event alerted Sewa Bharati activists. They staged a massive protest in Punjabi Bagh on September 18. Following the protest none of these Congress leaders turned up. Sewa Bharati has also initiated legal action against the fraud organisation.

    You talk about Human Rights First. Let us take your argument. What about the Human Right of the persons who are dead because of terrorists? Is it not the Human Right of those killed to live and support their families?

    If you agree, then the current institutional framework has failed in protecting the Human Rights of those who were killed in bomb blasts. Hence, the institutional framework has to be refined to protect the Human Right of the people of India , i.e. the Right to Live peacefully.

The ‘untouchable’ Dalits have started leaving Hinduism, which could lead to an immense growth of Indian churches” was Johnstone’s gleeful reply. So why do so many Christians in India conceal their faith, given that the rulers are Christian-friendly? The present Constitutional provision that limits the benefits available to Scheduled Castes only to Hindus (including Sikhs and Buddhists) is a major hurdle.

    I am very pleased to be with you at this function. I appreciate the initiative taken by the Bharatiya Vichar Manch to publish this timely and thought-provoking book Sachar Committee — Conspiracy to Divide the Nation? I also thank the Manch for inviting me to release the book.

Yesterday in Delhi I participated in the funeral of a brave police officer who became a martyr while trying to nab terrorists in their hideout. The Delhi Police have affirmed that these terrorists were actively involved in several terrorist acts, including the one in the national capital on 13th September that killed nearly two dozen innocent people.

    first off, the US & India are different geographically & demographically. I think any reduction in attacks there would be easier to achieve than over here simply, by clamping down on entry and you achieve sizeable reductions already without causing too much inconvenience to existing residents.

    This is the tricky bit, you’re saying that the opposite is true, ie POTA has been effectively used to root out terror. Can you show the basis for this premise ?

    That there were fewer incidents during POTA than after ?

    Is there any data to show that only during POTA, terrorism was at its lowest ?

    Ok, what about pre-POTA then ?

    I have this impressoin that attacks increased post 9-11 in comparison to before, because all of a sudden the extremists idea grabbed hold and was exploited, with lethal efficiency, worldwide.

    Rooting out terror is ideal, rather difficult to achieve maybe even optimistic.

    I was going to settle just for sizeable reductions. That to me is an achievable goal, get there and then we might be able to talk about rooting out.

    Otherwise in agreement with the rest of your critiques, a credible framework has to be advanced if POTA is not suitable.

    Let’s see, i get the impression that, this awareness has reached a critical mass.

    The unprecedented wave of anti-Christian attacks that began a month ago continued in the past week with more incidents of murder, rape and arson, mostly in the eastern state of Orissa and southern state of Karnataka. Two Christians were also found murdered in the northern state of Uttarakhand. By their own admission, Bajrang Dal and its sister Hindu militant outfts, have owned up these barbaric attacks and acts of terrorism ! BJP and RSS continues to be in a stae of denial as to their involvement….

    We need strong anti-terror laws (POTA is a failed law which did not help the NDA govt to achieve any thing at all in their fight against terorism) which can deal with both Islamic and Hindu radical militant outfits and punish the terrorists severly !

    Your title is grossly provocative. National Interest is important but what is national interest? It is the interest of the people living in the nation, that means their right has to be protected. In this sense human right is an inseperable part of National Interest. Nowaday’s the phrase “Human Rights” has been abused to a great extent by fundamentalist-aligned pseudo progressive NGOs and quasi governmental agencies. You only have to take a look at the recent Supreme Court judgement ruling that even though the Right to Property has been removed as constitutional right it is an important human right. I expect this portal to appeal to people’s thoughts rather than emotions. It should not degenerate into a forum where people simply vent their anger.

    I charge Sachar with contempt for human rights — there is not a single word in his article on the need to protect the human rights of terrorism victims.

    Human Rights vs Natoinal Interest is a false debate (like secularism vs communalism); a debate imposed on us by terrorism sympathizers who appropriated concern for human rights and make it sound like it is their dad’s property.

    If Sachar types insist, yes, Human Rights should indeed come first, but only of those who respect the rights of others. In other words, “human rights first” translates into the protection, first and foremost, of the rights (most importantly the right to life) of peaceful, law-abiding citizens.

    The mischief — and indeed the dishonesty — in Sacharite logic is that by “human rights” he actually means the “rights” of terrorists and terrorism-suspects; not of the victims of terrorism.

    She thinks the main problems are

    - ‘intel’ and goes as far to say that our agencies might be ‘infiltrated’. If the flow of drugs can’t be hampered then anything can come in. Tho if you notice with the last few incidents, after mumbai 2006, most have been ‘low intensity’ so there seems to be a change. I’d be surprised if we see an Islamabad size event happening here anytime soon.

    The police have sufficient powers to search, to seize, to enter premises. There is nothing that they don’t have. POTA comes into operation only after the police have completed their investigation; it does not give them any extra powers to investigate. It gives the judiciary extra powers to convict on the basis on confessions and things like that.

    POTA does not give the police any extra powers; they still have to investigate under regular law.

    So rationally rather than emotionally, show your counter arguments.

    First off, can we not use that hallowed expression, “War on Terror”? That war as we all know is fake – may be you don’t agree! And all the questions about 9-11 have not gone away, whether or not you agree with ‘conspiracy theorists’. So let’s also refrain from comparing our situation with US and UK and all those places where terrorism has become the in thing.

    And who defines National Interest? Ostensibly a lot of the good stuff Bush-Cheney and co have done have been in America’s national interest. Exxon and Halliburton would agree with that, doesn’t mean there is any legitimate national interest – or may be there is in the long run. So what do you intend for those suspected of terrorism? Torture, concentration camps or other benign forms of persecution would be in order I suspect. Terrorism (where it is real) must be dealt with, but it is a slippery slope (not that we have much to lose in our beloved country!) when you start fiddling with the foundations of the constitution.

    Madarsas and Mainstream Education
    Madarsas have played an important role in providing religious education to the
    Muslim population. They also provide ‘mainstream’ education in many cases and
    several of them are in the process of modernizing their curriculum. While this is an
    important initiative of the Community to improve educational conditions, it is
    important to take note of the fact that less than 4 per cent of the Muslim children
    in the school going age actually attend the full time regular Madarsas. Therefore,
    the modernized Madarsas are unlikely to satisfy the educational demand of the
    Community and the State will have to make provision for mainstream schools in
    areas where such schools are not available. In other words, Madarsas should not to
    be looked upon as alternatives to the regular school, but a complement. The
    following steps seem desirable:
     Work out mechanisms whereby Madarsas can be linked with a higher
    secondary school board so that students wanting to shift to a
    regular/mainstream education can do so after having passed from a Madarsa.
     Provision of “equivalence” to Madarsa certificates/degrees for subsequent
    admissions into institutions of higher level of education. Flexibility should be
    introduced so as to enable Madarsa graduates to move across to regular
    mainstream education after graduating from these institutions, if they so wish.
    In other words the opportunity should be made available to them, especially in
    courses where admission is done through an entrance test/ competitive
    examination.
     Recognition of the degrees from Madarsas for eligibility in competitive
    examinations such as the Civil Services, Banks, Defense Services and other such
    examinations. The idea is to facilitate a process whereby Madarsa graduates too
    have a choice and an incentive to participate in these employment streams.
    This should, however, remain within the existing framework of these
    competitive examinations.
     In the 1990s government introduced a scheme for modernization of Madarsas.
    This was a step in the right direction but it was robbed of part of its utility
    because of some deficiencies relating for example to choice of subjects , quality
    of teachers, accommodation of the modern subjects in a time-table intensely
    packed with traditional subjects. Government will be well advised to review and
    revamp the scheme before embarking on its expansion.

    Many of the things taught in madrasas are plainly divisive, and indoctrinate the “student” to think that he is special because he is a muslim. Growing up with Quranic teachings gradually turn you into a person who looks out not for India, but muslims only; to hell with anything other than Islam. If it is “bad” (eg other religions), it has to be destroyed; if it is “good” (eg. land, property) then it must be made Islamic.

    Madrasas are not in the national interest, and should be banned.

    “4% muslim children of schoolgoing age” is 4% too many. It is people like Justice Sachar who let madrasas fly under the radar, instead of them being in the national spotlight.
